Draft of 7 October 2026, pending legal review. Not yet a binding document.
Terms of Service
These terms govern the use of Explainted (the “Service”), run by [Company name], [address], Poland (“we”). By creating an account or uploading a book you agree to them. If you do not agree, do not use the Service.
1. What the Service does
You upload a book. The Service extracts its text and makes a course of lectures from it: the text retold at the level you choose, read aloud, with a drawing for every idea. You use the course in the web player and can download it as files (EPUB, FB2, PDF; MP3 and MP4 once studio narration is available).
The lectures, the drawings and the narration are produced by AI systems. How, and what that means for accuracy, is explained in How AI is used, which is part of these terms.
The Service is new and changes often. Features can be added, changed or withdrawn; where it matters, we try to say so in advance.
2. Account and age
An account is identified by an e-mail address and protected by a password. Keep the password to yourself and tell us if you think someone else has used your account.
You must be at least 16 years old to use the Service. If you are under 18, a parent or guardian must agree to these terms for you and make any top-up on your behalf.
One person, one account. You are responsible for what is done with your account.
3. Your uploads and copyright
You keep all rights to the books and texts you upload. We claim none of them.
You must have the right to upload a book and to have it processed as the Service does: because you wrote it, because it is in the public domain or under a licence that allows this use, or because the law that applies to you allows this use of a copy you own. Checking this is your responsibility; we cannot check it for you.
Uploads are private: only you can see them. We do not share uploaded books with other users and do not use them to train AI models; under their API terms, neither do our AI providers.
To make the course we need your permission to store the book, extract its text, send extracts to our AI providers and keep the result in your account. By uploading, you give us that permission, for that purpose only, for as long as the book stays in your account.
Takedown. If you believe a book on the Service infringes your rights, write to takedown e-mail with the title, the grounds of your claim and where you saw it. We remove infringing material and may close the accounts of repeat infringers.
4. Generated content and its limits
Except at the first level (“As written”), where the book’s own text is read, the lectures are a retelling written by a language model, not the author’s text. The drawings are generated; the narration is synthetic. More in How AI is used.
A retelling can be wrong: it can misstate a fact or a formula, drop a qualification, add a detail that is not in the book, or draw a scheme that does not match the sentence. Treat the course as a study aid, not a substitute for the book, and check anything you rely on against the source. The Service gives no professional advice of any kind.
You may use the courses you make for your own study and share them by link where the Service allows it. We claim no copyright in the courses. Whether AI-generated material can be protected by copyright, and who holds it, is unsettled in many countries, and a course built on a copyrighted book may count as a derived work of it; so we cannot promise that you may publish or sell a course, and you should take advice before you do.
If you pass on a course or a file made with the Service, keep it marked as AI-generated.
5. Tokens, top-ups and refunds
The free sample costs nothing. Making the lectures is paid from a prepaid balance kept in tokens. The price of a job is shown in tokens, with its value in money beside it, before the job starts.
When a job starts, its quoted tokens are set aside; when it ends, you are charged for what was made: the whole quote for a finished course, a share for one that stopped half-way, nothing if nothing was made. The account page shows the balance, what is set aside, and every top-up and charge.
Top-ups. Card payment is not connected yet. Until it is, tokens reach a balance only through top-up codes we issue. When payment is connected, these terms will say how it works, what the tokens cost and which taxes apply.
Tokens are a prepayment for the Service, not money and not an investment. They cannot be transferred to another account or exchanged for cash, except as the refund rule says.
Refunds. Unused tokens you paid for are refunded in money on request within 14 days of the top-up. Tokens spent on a finished job are not refunded: the lectures are digital content delivered immediately at your request, and by starting a job you agree that it starts at once and that you give up the right of withdrawal for that job. If a job fails on our side, you are charged only for the parts that were made, and you can ask us to review the charge.
If we close the Service, or your account through no fault of yours, we refund the unused tokens you paid for.
6. Acceptable use
Do not upload material that is illegal or that you have no right to upload. Do not try to break into the Service, overload it, or extract the instructions given to its models. Do not use the Service to make unlawful material. We may refuse any upload or job, and may suspend or close an account that breaks these terms.
7. Privacy
How we handle personal data is set out in the Privacy Policy.
8. Liability
The Service is provided as it is, while it is being developed. We do not promise that it will be available without interruption, or that the lectures will be correct or complete (see section 4).
To the extent the law allows, we are not liable for indirect losses, lost profit or lost data, and our total liability to you in any twelve months is limited to the amount you paid us in that period. Nothing in these terms limits liability for intent or gross negligence, or the rights that consumer law gives you and that cannot be waived.
If a third party makes a claim against us because of a book you had no right to upload, you are responsible for the loss this causes us, to the extent the law allows.
9. Changes and ending
We may change these terms. We announce material changes at least 14 days before they take effect, on the site or by e-mail. If you do not agree, close your account before that date and we refund the unused tokens you paid for.
You may close your account at any time by writing to contact e-mail; we then delete your data as the Privacy Policy describes. We may close an account that breaks these terms, or close the Service, with notice and the refund in section 5.
10. Governing law and disputes
These terms are governed by the law of Poland, and disputes go to the Polish courts. If you are a consumer in the EU, you keep the protection of the mandatory law of the country where you live and may bring a claim in its courts. Consumers in Poland may also use out-of-court dispute resolution; the list of bodies is published by the Office of Competition and Consumer Protection (UOKiK).
